“Image rights represent the asset based on which the livelihood of professional sportsmen and sportswomen depends and, given the limited lifespan of an international sporting career, maximum benefit must be extracted from these assets while they are valuable and in demand.”

“Image Rights means the right for any commercial or promotional purpose to use the Player’s name, nickname, slogan and signatures developed from time to time, image, likeness, voice, logos, get-ups, initials, team or squad number(as may be allocated to the Player from time to time), reputation, video or film portrayal, biographical information, graphical representation, electronic, animated or computer-generated representation and/or any other representation and/or right of association and/or any other right or quasi-right anywhere in the World of the Player in relation to his name, reputation, image, promotional services, and/or his performances together with the right to apply for registration of any such rights.”

What are Image Rights?Image rights are the expression of the personality in the public domain. The provision of image rights in law will enable the definition, value, commercial exploitation and protection of image rights associated with a person.
What are the elements of an Image Right?The right to commercially exploit the following personal attributes: Voice, Photograph, Film, Signature, Likeness, Appearance, Gesture, Mannerisms, Electronic or other representation (including that of an avatar), Any other distinctive characteristics and personal indicia by which a personality is immediately identifiable
Can you currently register image rights?Although image rights are managed through a variety of corporate structures in other jurisdictions at the moment, there is no other jurisdiction in the world that has image rights legislation with an image rights register. Guernsey is the first jurisdiction to enact image rights legislation.
Image rights are high value but a current lack of definition in law leads to uncertainty as to the extent of the rights and the limits the value-creation opportunities.
